Membership Terms

These Membership Terms govern the Oval plans, including the free Core plan and the optional Plus Membership (together, the "Membership"), offered by [Oval , Inc.] ("Oval," "we," "us," or "our"). The Plus Membership is optional. These Membership Terms form part of, and are governed by, our Terms of Service.

1. Overview

Every Oval Sleep System includes the Core experience for free, for as long as you own your system. The optional Plus Membership unlocks advanced adaptive features and the full sleep and wellness insights suite. These terms explain what each plan includes, how billing works, and how to cancel.

2. What Is Included Without a Membership (Core — Free)

• Basic Controls: App Control and Manual Control

• Adaptive Temperature Control: Adaptive control during sleep

• Sleep Insights: Sleep Quality, Sleep Duration, Heart Rate, and Respiratory Rate

• Software and firmware updates

• Customer support

• [2]-year limited hardware warranty

3. What the Plus Membership Adds

*Daytime Insights requires data from Apple Health or Health Connect.

The feature list above reflects the current plan structure and may be updated as our products evolve. If we change the features included in the Core or Plus plan, we will notify members in advance.

One Membership covers all Oval Sleep Systems registered to the same account within a single household.

4. Plans and Pricing

• Prices are shown in U.S. dollars. Where a price is displayed in a local currency, it is converted from the U.S. dollar price at the applicable exchange rate, and the amount charged in your local currency may vary with the exchange rate applied at the time of renewal.

• Applicable taxes are added at checkout or on your platform invoice based on your billing address and applicable law.

• Your Plus Membership is purchased and billed through the Apple App Store or Google Play, depending on the device and store account you use. Payment is collected by that platform from the payment method on file.

• Your billing cycle begins on the date you activate the Plus Membership.

5. Billing and Automatic Renewal

• Your Plus Membership will automatically renew at the end of each billing period at the then-current rate unless you cancel before your renewal date.

• You may turn off automatic renewal at any time in your platform subscription settings. If automatic renewal is off, your membership expires at the end of the current paid period.

6. Cancellation

• You may cancel at any time. There is no cancellation fee.

• Your subscription is managed by the platform you subscribed through (the Apple App Store or Google Play), and cancellations are handled through that platform. The platform's cancellation rules govern how and when your cancellation takes effect.

• Unless the platform's rules provide otherwise, cancellation takes effect at the end of your current billing period, and you will continue to have access to Plus features until then.

• After your Plus Membership ends, your system continues to work with the Core features described in Section 2.

• Uninstalling the Oval app or deleting your Oval account does not cancel your subscription. You must cancel through the platform you subscribed with.

7. Refunds

• Membership fees are billed by the platform you subscribed through and are refunded in accordance with that platform's refund policy. Refund requests for Membership fees should be submitted to Apple or Google, as applicable.

• If you return your Oval Sleep System in accordance with our Return Policy, we will refund the hardware in accordance with that policy. Membership fees are not automatically refunded with the hardware — the Membership refund must be requested separately through the platform you subscribed with.

• Hardware refunds are issued to the original payment method.

8. Price Changes

We may change Membership pricing. If we do, we will notify you in advance as required by applicable law, and the new price will apply starting with your next renewal. You may cancel before the new price takes effect if you do not wish to continue.

9. Accounts and Household Use

• Each user should create their own Oval account in order to receive personalized temperature settings and individual sleep data.

• You may invite another person to link their account to your system. Linking accounts share Membership benefits only — sleep reports and health data are not shared with the linked user. Either user may unlink at any time in the app.You are responsible for all activity under your account. Accounts and Memberships may not be shared, sold, transferred, or assigned to another person.

• We may suspend or terminate an account that violates these terms.

10. Service Availability and Updates

• The Membership depends on an internet connection, the Oval app, and our services. Temporary interruptions may occur due to maintenance, third-party service disruptions, or connectivity issues. We work to maintain availability but do not guarantee uninterrupted or error-free access.

• We may add, modify, or discontinue features from time to time. If a change materially and adversely affects the core benefits of your Membership, we will provide reasonable advance notice and comply with applicable law.

• The system may receive automatic software and firmware updates.

11. Data and Health Disclaimer

• We collect and process system data, sleep data, and biometric measurements in order to provide the Membership. See our Privacy Policy for details about how we collect, use, and disclose personal information.

• Sleep insights, including Plus features such as HRV, Sleep Stages, and Daytime Insights, are wellness features. They are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Do not make medical decisions based on this information.

12. Purchases from Unauthorized Sellers

The Membership is available only for Oval Sleep Systems purchased directly from ovalhome.com or from an authorized Oval retailer. Systems purchased from unauthorized resellers, unauthorized sellers on third-party marketplaces, or secondhand sources are not eligible for the Membership, the limited warranty, or customer support. The Membership is non-transferable.

13. Changes to These Membership Terms

We may update these Membership Terms from time to time. If we make a material change, we will notify you in advance as required by applicable law. Continued use of the Membership after the effective date constitutes your acceptance to the extent permitted by applicable law.
